Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Delphine mobile application and web portal (collectively, the "Service"), operated by Christopher Bevard ("we," "us," or "our"). By creating an account or using Delphine, you agree to be bound by these Terms.

Important: Delphine is a health tracking and organization tool. It is not a veterinary service, does not provide medical advice, and is not a substitute for professional veterinary care. Always follow your veterinarian's guidance for your pet's diagnosis, treatment, and medication.

1. Eligibility

You must be at least 18 years old to use Delphine. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

Veterinary professionals using the vet portal represent that they are licensed veterinary professionals or authorized staff members of a registered veterinary practice.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate and complete information when creating your account
Keep your password secure and not share it with others
Notify us immediately at info@delphinepet.com if you suspect unauthorized access to your account
Not create accounts for others without their permission

3. Medical Disclaimer

Delphine provides tools for organizing and tracking pet health information. The Service does not:

Diagnose medical conditions
Recommend or prescribe medications or dosages
Replace veterinary consultation or care
Provide real-time monitoring or emergency services

All condition information, target ranges, medications, and dosages entered into Delphine must come from a licensed veterinarian. Delphine does not verify the accuracy of information you or your vet enter. Never start, stop, or change a medication or dosage based on information in the app without first consulting your veterinarian.

If your pet is experiencing a medical emergency, contact your veterinarian or nearest emergency animal hospital immediately. Do not rely on Delphine in an emergency.

4. Acceptable Use

You agree to use Delphine only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service to enter false, misleading, or fraudulent information
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers connected to the Service
Use the Service in any way that violates applicable laws or regulations
Share your account with others or allow others to access the Service through your account (except caregivers invited through the proper caregiver sharing feature)
Reverse engineer, decompile, or attempt to extract the source code of the Service

5. Subscriptions and Payments

Owner subscriptions: Delphine offers free and paid subscription tiers for pet owners. Paid subscriptions are billed through Apple's App Store and are subject to Apple's terms and refund policies. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID account settings.

Veterinary practice subscriptions: Vet portal subscriptions are billed monthly through Stripe. You may cancel at any time through the billing portal in your account settings. Cancellations take effect at the end of the current billing period — no partial refunds are issued for unused time.

Price changes: We reserve the right to change subscription prices with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Your Content

You retain ownership of all information, data, and content you enter into Delphine ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you.

You are responsible for the accuracy of Your Content. We do not verify or validate information entered into the Service.

7. Data Sharing with Veterinary Professionals

When you connect your account with a veterinary practice through Delphine, you authorize that practice to view your pet's health data including logs, medications, and reports. You may revoke this access at any time through your account settings. Veterinary professionals who access your pet's data through Delphine are responsible for using that data in accordance with their professional obligations and applicable laws.

8. Intellectual Property

The Delphine name, logo, app design, and all related intellectual property are owned by Christopher Bevard. Nothing in these Terms grants you the right to use our trademarks, trade names, or logos without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHRISTOPHER BEVARD AND DELPHINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO YOUR PET'S HEALTH OR MEDICAL OUTCOMES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Christopher Bevard and Delphine from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time through your account settings or by contacting us at info@delphinepet.com.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including sections 9, 10, and 11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Illinois.
